IMPORTANT FOOD PREPARATION & REGULATORY NOTICE
All food items offered through this Site are prepared exclusively in a permitted and inspected commercial commissary (shared) kitchen, in compliance with applicable provisions of the California Retail Food Code (CRFC) and under the authority of the County of San Diego Department of Environmental Health and Quality (DEHQ).
- Food is not prepared in a home kitchen
- Food preparation, storage, warewashing, freshwater supply, wastewater/trash disposal, and sanitation occur only at approved, permitted facilities
- Food is offered on a pickup-only basis (no delivery, no on-site or dine-in consumption)
- Operations follow applicable state and county food safety requirements, including required food handler and food manager certifications
By accessing the Site or placing an order, you acknowledge and accept these operational limitations.
1. Role of the Website
For purposes of these Terms & Disclaimer:
“Site Owner” or “Website Operator” means Soon Ahn, an individual, doing business as “Webcodegen Studio” (a temporary trade name), and any successor legal entity that may be formed, which owns and operates the website platform.
“Food Provider” means Soomee’s Kitchen, an independent business entity responsible for all food-related activities.
The Site (https://soomeeskitchen.com) operates as an independent online food ordering platform.
The Site Owner:
- Operates and maintains the website platform, including technical functionality, order interface support, analytics, and third-party advertising services.
The Food Provider:
- Operates as an independent business entity.
- Is solely responsible for food preparation, ingredient sourcing, food safety, allergen handling, and regulatory compliance at the approved commissary kitchen.
The Site Owner does not own, control, or supervise the Food Provider’s food operations.
Use of the Site constitutes your agreement to these Terms & Disclaimer.
If you do not agree, please do not use the Site or place an order.
2. Pickup-Only Food Services Disclaimer
All orders are pickup-only.
The Site Owner acts solely as a technology platform provider and is not involved in food preparation or handling.
Responsibility for food preparation, ingredients, allergen disclosures, food safety, handling, and regulatory compliance rests entirely with the Food Provider.
2(a). Allergen & Food Safety Notice
- Food is prepared in a shared commercial kitchen environment where multiple allergens may be present
- Major food allergens recognized under U.S. law may include milk, eggs, fish, crustacean shellfish, tree nuts, peanuts, wheat/gluten, soybeans, sesame, and others
- Cross-contact with allergens may occur despite reasonable cleaning and safety procedures
- Menu descriptions may disclose known allergens, but no item is guaranteed to be allergen-free
Consumption of food is at the customer’s own risk. Customers with allergies or sensitivities should exercise personal judgment before ordering.
3. Orders and Payments
Online card payments may become available after the effective date of these Terms due to technical setup requirements.
Orders can be placed only using payment methods available at the time of checkout.
Billing information may be retained by the payment processor for fraud prevention, chargeback handling, and legal compliance.
Payments are handled securely by third-party processors (e.g., Stripe).
The Site Owner does not store full credit/debit card numbers, CVV codes, or complete payment credentials.
Orders are final once submitted and payment is processed.
4. Refunds, Cancellations, and Chargebacks
Due to the perishable nature of food and advance preparation:
- All sales are final; no refunds, exchanges, or cancellations after order confirmation
- Missed pickups, late arrivals, or no-shows result in forfeiture without refund
- Limited exceptions may be granted solely at the discretion of the Food Provider
- Unauthorized or excessive chargebacks may result in order refusal or account restrictions
All prices displayed include all mandatory fees except applicable taxes, in compliance with California law.

5. Service Availability & Technical Limitations
The Site Owner is not responsible for:
- Outages or failures of third-party services
- Delays or errors caused by technical issues, maintenance, or events beyond reasonable control
- Menu changes, pricing updates, availability, or pickup times determined by the Food Provider
6. Advertising Disclaimer
The Site may display third-party advertisements (e.g., Google AdSense).
The Site Owner is not responsible for the content, accuracy, privacy practices, or any interactions or losses related to third-party advertisements. Such matters are solely between you and the advertiser.
Advertising services may involve the collection or sharing of personal information for cross-context behavioral advertising, which may constitute “sharing” under the CCPA/CPRA.

7. Informational Use Only
All content on the Site is provided for general informational purposes only and does not constitute legal, medical, dietary, or nutritional advice.
8. Limitation of Liability
To the maximum extent permitted by California law, and except for gross negligence, willful misconduct, fraud, or intentional violation of law:
The Site Owner shall not be liable for:
- Foodborne illness, allergic reactions, contamination, spoilage after pickup, or improper storage
- Missed pickups, payment disputes, or chargebacks
- Any indirect, incidental, consequential, punitive, or special damages
Food-related claims are solely the responsibility of the Food Provider.
If liability is imposed despite the foregoing, the total liability of the Site Owner shall not exceed the amount paid by the user for the specific order giving rise to the claim.
9. Indemnification
You agree to indemnify, defend, and hold harmless the Site Owner from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of:
- Your use of the Site
- Consumption of food provided by the Food Provider
- Violation of these Terms & Disclaimer
This does not apply to claims arising solely from the Site Owner’s gross negligence or willful misconduct.
10. Governing Law & Venue
These Terms are governed by the laws of the State of California.
Any dispute shall be resolved exclusively in the state or federal courts located in San Diego County, California.
11. Changes to Terms
These Terms may be updated periodically. Continued use of the Site constitutes acceptance of the revised Terms.
