IMPORTANT FOOD PREPARATION & REGULATORY NOTICE
All food items offered through this Site are prepared exclusively in a permitted and inspected commercial commissary (shared) kitchen, in compliance with applicable provisions of the California Retail Food Code (CRFC) and under the authority of the County of San Diego Department of Environmental Health and Quality (DEHQ).
- Food is not prepared in a home kitchen
- Food preparation, storage, warewashing, freshwater supply, wastewater/trash disposal, and sanitation occur only at approved, permitted facilities
- All orders are pickup-only (no delivery, no on-site or dine-in consumption)
- Operations follow applicable state and county food safety requirements
By placing an order or using this Site, you acknowledge and accept these operational conditions.
1. Role of the Website
For purposes of this Policy:
“Site Owner” means Soon Ahn, an individual, doing business as “Webcodegen Studio” (a temporary trade name), and any successor legal entity that may be formed, which provides and maintains the website platform and related technical services.
“Food Provider” means Soomee’s Kitchen, an independent business entity responsible for all food-related activities.
The Site (https://soomeeskitchen.com) provides an online food ordering platform.
The Site Owner:
- Provides and maintains the online ordering platform and related technical services
- Does not prepare, handle, store, transport, or sell food
The Food Provider:
- Operates as an independent business entity
- Is solely responsible for food preparation, food safety, regulatory compliance, and order pickup under its commissary authorization
The Site Owner has no responsibility or liability for food preparation, handling, storage, or food safety.
2. Refunds & Cancellations
Due to the perishable nature of food, advance preparation, and food safety regulations:
This refund policy applies only to completed and successfully paid orders.
Online card payments are enabled only after payment processing setup is completed.
No refunds apply to orders that were not successfully paid.
2(a). No Refund Policy
All sales are final.
No refunds, exchanges, or credits are provided once an order is confirmed and payment is processed.
2(b). Limited Exceptions
Any refund or exception may be granted solely at the discretion of the Food Provider (e.g., a confirmed operational error by the Food Provider).
Such discretion does not create any obligation, precedent, or ongoing right to refunds.
The Site Owner has no authority or obligation to approve, issue, or mediate refunds.
2(c). Cancellations, Changes & Missed Pickup
- Cancellations or order changes after confirmation do not entitle the customer to a refund
- Missed pickups, late arrivals, or no-shows result in forfeiture of the order without refund
- Food not picked up within the designated pickup window may be discarded for food safety reasons
2(d). Payment Disputes & Chargebacks
Payment disputes or chargebacks are handled between the customer, the payment processor (e.g., Stripe), and the Food Provider.
Excessive, unauthorized, or fraudulent chargebacks may result in refusal of future service.

3. Food Safety & Allergen Policy
3(a). Allergen Information
Food may contain or come into contact with major food allergens recognized under U.S. law, including but not limited to:
- Milk
- Eggs
- Fish
- Crustacean shellfish (e.g., crab, lobster, shrimp)
- Tree nuts
- Peanuts
- Wheat / Gluten
- Soybeans
- Sesame
Ingredients and known allergens are disclosed to the best of our knowledge in menu descriptions.
3(b). Shared Kitchen & Cross-Contact Notice
Food is prepared in a shared commercial kitchen environment where multiple allergens may be present.
Cross-contact with allergens may occur despite reasonable cleaning and safety procedures.
No item is guaranteed to be allergen-free.
3(c). Customer Responsibility
Customers are responsible for:
- Reviewing ingredient and allergen information before ordering
- Informing the Food Provider of severe allergies or dietary concerns prior to pickup
- Deciding whether to consume food based on their personal health needs
3(d). Transfer of Responsibility at Pickup
Responsibility for food safety, temperature control, storage, and handling transfers to the customer at the time of pickup.
The Food Provider is not responsible for spoilage, illness, or issues arising from improper handling or storage after pickup.
3(e). Limitation of Liability
To the maximum extent permitted by California law, and except where liability cannot be excluded by law (including willful injury under California Civil Code §1668):
- The Food Provider shall not be liable for allergic reactions, foodborne illness, or contamination, except as required by applicable law.
- The Site Owner shall not be liable for any food-related claims, including illness, allergic reactions, or spoilage.
- Neither Party shall be liable for any indirect, incidental, or consequential damages.
4. Acceptance of Policy
By placing an order, completing pickup, or consuming any food item, you acknowledge that you have read, understood, and agree to this Refund & Food Safety Policy.
